What are the key principles that should drive Australia’s regulatory approach to legal metrology?

Key principles
At all times industry need to be informed on how the legal or required procedures should be met.

Not enough basic information pertaining to the Baking industry. Sometimes the information is broad. Bakeries are unsure if this is actually meant for their business.

What level of guidance material, if any, should be available to ensure stakeholders have sufficient understanding of the policy objectives and outcomes being sought?

Level of guidance material
Perhaps workshops or funding to industry bodies to go out and spread the word to members once the industry body has engaged with the Institute.

What should be the legislative status of such guidance material?

The guidance material is very important but must be work or put together with support from the industry body.

Risk-based approach to compliance monitoring

What are the appropriate factors to inform risk management related to setting priorities for regulation of legal metrology, including compliance and enforcement activity?

Factors to inform risk management
We would agree that after a period of consultation from Institute to industry body to industry that audits or checks be carried out. It is important however that this be across the country not just in pockets and that all business owners be subject to the checks/audits.

Focus of regulatory activity in relation to conformity
It needs to bring industries together for example in the food industry some do manufacturing and retail???

How should NMI focus its compliance activities to ensure businesses are meeting their obligations under trade measurement law?

There needs to be full blanket coverage on audits/inspections and this can only be done once industry has been engaged.

What relative weight should NMI give to: identifying that certain thresholds have been breached; and individual risk assessments, before financial penalties are imposed?

In the past the baking industry seen inspectors call in on a few bakeries in different areas of NSW. But this soon stopped and it appeared only a few bakeries in each street were targeted. We would welcome and support a full coverage on inspections etc and are happy to discuss further
